Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your use of PulseScribe, a voice dictation application for macOS, and related services provided by TATEX GmbH ("we", "us", "our").

By using PulseScribe, you agree to these Terms. If you do not agree, please do not use our software or services.

2. Open-Source Software

PulseScribe is available as open-source software under the MIT License. You may use, copy, modify, and distribute the software in accordance with the license terms available at: github.com/KLIEBHAN/pulsescribe

The open-source version is provided "as is" without warranty of any kind, express or implied.

3. PulseScribe Pro (Beta)

PulseScribe Pro is a paid subscription service that provides managed transcription without requiring your own API keys.

3.1 Beta Program

PulseScribe Pro is currently in beta. During the beta period:

  • Features may change without notice
  • Service availability is not guaranteed
  • Pricing may be adjusted (existing subscribers will be notified in advance)

3.2 Subscription & Billing

  • Pro subscriptions are billed monthly at €9/month
  • Payment is processed through our payment provider (Stripe)
  • You may cancel your subscription at any time; access continues until the end of the billing period
  • No refunds are provided for partial months

3.3 Fair Use Policy

Pro subscriptions are intended for individual use. We reserve the right to limit or terminate accounts that exhibit excessive or abusive usage patterns.

4. Acceptable Use

You agree not to use PulseScribe to:

  • Violate any applicable laws or regulations
  • Process audio content that is illegal, harmful, or infringes on others' rights
  • Attempt to reverse engineer, exploit, or attack our infrastructure
  • Share or resell Pro subscription access without authorization
  • Use automated systems to abuse the service (e.g., excessive API calls)

5. Third-Party Services

PulseScribe integrates with third-party transcription providers (Deepgram, OpenAI, Groq). Your use of these services is subject to their respective terms:

We are not responsible for the availability, accuracy, or policies of third-party services.

6. Intellectual Property

The PulseScribe name, logo, and branding are trademarks of TATEX GmbH. The open-source code is licensed separately under MIT.

You retain all rights to your audio recordings and transcriptions. We do not claim ownership of your content.

7. Limitation of Liability

To the maximum extent permitted by law, TATEX GmbH shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of data, profits, or business opportunities
  • Errors or inaccuracies in transcriptions (including medical, legal, or financial content)
  • Service interruptions or downtime, whether planned or unplanned

Our total liability is limited to the amount you paid for Pro services in the 12 months preceding the claim, or €50, whichever is greater.

8. Disclaimer

PulseScribe is provided "as is" and "as available" without warranties of any kind. We do not guarantee:

  • 100% accuracy of transcriptions
  • Uninterrupted or error-free service
  • Compatibility with all macOS versions or hardware
  • Suitability for any particular purpose

Important: Do not rely on PulseScribe for critical applications (medical, legal, safety) without human verification.

9. Termination

We may suspend or terminate your access to Pro services if you violate these Terms. You may cancel your subscription at any time through your account settings.

Upon termination, you retain the right to use the open-source version of PulseScribe under the MIT License.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email (for Pro subscribers) or by posting on this page. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved in the courts of Stuttgart, Germany.
